Paralympics Athlete Swimmer Jessica Long is an Inspiration

A MESSAGE FROM DARREN KAVINOKY

The 2016 Paralympic Games in Rio are about to begin. I am in awe of the spirit and achievements of athletes like swimmer Jessica Long. As the most decorated athlete with 17 Paralympic medals, Jessica Long’s story is one of triumph.

She was born in Siberia and adopted from an orphanage in Russia to be raised in Baltimore Maryland. Jessica was born with a condition called fibular hemimelia and, as a result, she was missing important bones in her ankles and feet.

At 18 months of age, the lower parts of her legs were amputated in order for prosthetics to be put in place. She began swimming at the age of 10 and competed in her first Paralympic Games in 2004.

Jessica is an inspiration to all of us and proof that it isn’t where you begin in life, it’s where you end up that matters.

You don’t have to be better than anybody else, you just have to be better than you were yesterday.

I will be rooting for Jessica at the 2016 Paralympic Games and all of the incredible athletes ready to pour their hearts out in Rio.

Cleveland Police Officer Acquitted – Where Was the Jury?

Officer Michael Brelo, a Cleveland Police Officer, was acquitted on charges of voluntary man slaughter. He stood trial for his role in the death of an unarmed couple in Cleveland, Ohio back in November of 2012.

The, nationally-covered case out of Cleveland, Ohio, involves the death two African American individuals and the Cleveland police force. Officer Brelo went before a court to determine whether his decisions resulted in the deaths of two suspects. These suspects were later found to have been unarmed.

The Background

The case began on November 29, 2012, when police tried pulling over a Chevy Malibu for a turning signal violation. The driver, 43-year old Timothy Russell and his passenger, 30-year old Melissa Williams were both in the car.

Russell tried getting away from the officer and the car backfired.  Thinking the backfire was the sound of gun shots, officers pursued with force. Almost 62 police cars across the city of Cleveland followed in pursuit of Russell and Williams.

The chase ended just before 11pm, in the staff parking lot of Heritage Middle School, in East Cleveland, when the police penned the car in the lot. There, 13 officers opened fire, shooting at least 137 rounds into the vehicle. Officer Michael Brelo, a seven-year veteran, faced charges for jumping onto the hood of the car, and continuing to shoot 15 rounds into the vehicle. Prosecutors claimed that by this time, the threat was over. However, Brelo was the only one to continue shooting.

The Verdict – Not Guilty

On Saturday, May 23, the ruling came back, acquitting Officer Brelo of voluntary manslaughter and felonious assault charges. Many have been quick to jump on the court’s decision as a miscarriage of justice, and Cleveland has been the site of rioting since the verdict came down. However, there are several elements of the court’s decision that need to be fully fanned out to be understood completely.

Judge and No Jury

One thing that needs to be understood is why it was a judge making the decision, and not a jury.

Defendants in many criminal trials have a right to a jury. However, the defendant does not have to exercise this right. Defendants can choose to waive their right to trial by jury, and go for a bench trial. Bench trials don’t have a jury in the courtroom; there’s only a judge. The judge takes over the role of the jury. This means the judge now determines fact from fiction in addition to his or her typical role as a referee.

In this case, it was probably a wise move by the defendant  and his defense attorneys to waive his right to a jury trial. The Cleveland Police Officer’s actions were aggressive and, particularly in light of recent police conduct in Ferguson and Baltimore, likely to be unpopular. Jurors would be much more likely to weigh these factors into their decision of whether Officer Brelo was guilty, or not, whereas a judge would be more likely to ignore these perceptions of law enforcement, and focus solely on Officer Brelo’s conduct.

O’Donnell spent almost an hour explaining his decision before the court, in great detail, providing a rare glimpse into a judge’s mind in determining exactly what happened in a complex situation.

While this case happened outside the California border, it sheds light on court proceedings in criminal trials everywhere.

Another NFL Player Domestic Violence Arrest

Sadly, it comes as no huge surprise another NFL football player was arrested for domestic violence.  For some time now, domestic violence has been an increasing problem for the National Football League (NFL). Many advocates to reduce the amount of violence claim the professional football teams are not doing enough to penalize players accused of violence off the field.

Due to this pressure, and significant amount of publicity with violent crime and the NFL, the National Football League recently updated their personal conduct policy to try and address some of the criticism. However, domestic violence by players continues to plague the sport today.

Ray McDonald Dropped from the Bears

The Chicago Bears released Ray McDonald after arresting him on domestic violence charges in Santa Clara, California. McDonald was a major part of the Bears defense strategy for the season, but after this arrest, they chose to let him go.

Police arrested the 30-year-old defensive end after he allegedly assaulted a woman inside his apartment. The incident took place sometime before 4 a.m. on a Monday morning. According to police reports, McDonald allegedly broke down a bedroom door to get to his former fiancée and their infant child.  when the police arrived, McDonald was not on the scene.

The Santa Clara police department issued McDonald a restraining order for the protection of his fiancée and child.

However, on Wednesday, police arrested McDonald for a second time in a week for violating the restraining order.

Santa Clara detectives found him in a Togo’s sandwich shop in Santa Clara and booked him in a San Jose jail. He reportedly made bail, for $5,000. According to his attorney, they did not know about the restraining order.

A History of “Poor Decision Making”

This wasn’t the first time the defensive lineman was in trouble with the law. This was his third arrest in 9 months. In August 2014, police arrested McDonald on suspicion of domestic violence. In December of the same year, he was arrested for alleged sexual assault. McDonald defended the sexual assault claims as being consensual and filed a defamation suit. Although the victim did not file criminal charges, the 49ers dropped him from the team, citing “a pattern of poor decision-making.”

Then, the Bears picked him up. Despite his past arrests, based on a solid conversation, the team trusted he would behave. This did not happen. According to the team General Manager, Ryan Pace:

Revised Personal Conduct Policy

In late 2014, the NFL teams introduced a revised Personal Conduct Policy. Aimed at addressing domestic violence and sexual assault, the NFL put their heads together to bring about new order . The hope is this new policy will increase accountability and decrease criminal acts. The policy includes funding for counseling of victims as well as violators as well as provides guidelines for independent investigative procedures.

California DUI Laws versus Other States – Comparisons

Not all states carry laws as tough as California DUI laws. However, California is not the most strict.

Anyone unfortunate enough to face a conviction of driving under the influence in California is familiar with the harsh the penalties. A first-time DUI in L.A. can mean up to 6 months in jail, fines of up to $1,000 or more, probation, a drug or alcohol education program, an ignition interlock device (IID) installed in your car, and expensive higher insurance premiums. You may think California ranks near the top of U.S. states when it comes to DUI penalties, but according to a recent study, California falls somewhere in the middle.

DUI Rankings for All 50 States

Wallet Hub did a survey of DUI laws in all 50 states and Washington, D.C., ranking states from harshest to most lenient. They considered a number of factors in their analysis, including:

  • minimum jail time for a first offense DUI;
  • number of DUIs before it is considered a felony;
  • look-back period in counting DUIs;
  • higher BAC penalties;
  • fines and fees;
  • enhanced penalties for child endangerment;
  • mandatory IID installation;
  • administrative license suspension period;
  • alcohol and drug abuse treatment programs;
  • impounding vehicles after a DUI;
  • use of sobriety checkpoints; and
  • increased insurance rates.

Who Came Out on Top

California DUI laws are not as intense as other states. Neighboring Arizona had the strictest DUI laws, with a minimum 10-day jail sentence even for a first offense. Coming down much softer on DUIs are the District of Columbia and South Dakota, where even a second DUI carries no minimum jail sentence.

California ranked 34th when it came to strict DUI laws. However, it is not clear whether the survey included the limited use of mandatory IID installation after a first offense DUI. California is testing mandatory IIDs as a pilot program in four counties: Alameda, Los Angeles; Tulare and Sacramento. Lawmakers are considering taking the program statewide.

Understandably, states are following the trend of enacting even stricter laws aimed at drunk driving. Starting July 1st, a new IID law went into effect in Connecticut. Now all first offense DUI convictions require an IID in their car, whereas before it was only for repeat offenders. Now, about half of all states have an IID requirement for a first-time DUI.

A Wisconsin lawmaker proposed a new law. According to Mothers Against Drunk Driving (MADD), the law closes a loophole in the state’s IID requirements. Consequently, it creates a type of license where violating IID requirements is a criminal offense, rather than just a citation. Wisconsin requires IIDs for repeat drunk drivers, those who refuse a chemical test, and for first-time offenders with a BAC of 0.15% or higher.

Washington state is considering strengthening their DUI laws as well. In most states, a third or fourth DUI within the specified look-back period is considered a felony. In Washington, repeat offenders wait until their fifth DUI before they face a felony charge. Due to this, State Senators have introduced a bill that would lower the felony DUI number to the 4th DUI.

Alternative Punishments for DUI

While some state lawmakers, advocates, and groups such as MADD fight for stricter DUI penalties, others are moving towards more preventative measures. California DUI laws now include increasing the use of IIDs after a DUI conviction. This prevents a driver from taking to the road if they don’t blow a clean breath. California may make this move to bring the mandatory IID program to the rest of the state if the pilot program succeeds.
